Effective as of Jun 24, 2025. ScanSnap Account Registration Policy ------------------------------------------------------------------------ 1. When This ScanSnap Account Registration Policy Applies (1) This ScanSnap Account Registration Policy (this "Policy") applies to a user ("You" or "User") of each scanner product listed below ("Scanner Product") offered by Fujitsu Australia Limited, a corporation registered in Australia ("We", "Us", or "PFU") when You register an online account ("User Account") in order to download and install the Scanner Product's operating software on Your multiple devices. (2) By registering a User Account, You agree to the terms of this Policy. 2. How to Register a User Account (1) In order to use the Scanner Product with ScanSnap Cloud, you must register an User Account in accordance with this Policy. (2) In order to register Your User Account, You must provide (i) a valid email address and (ii) a password (collectively, "Account Registration Information"). (3) Registered User Account may download and use the Software for multiple supported devices linked devices. (4) You must promptly notify Us of any change to Your Account Registration Information through the "ScanSnap Account Registration Information" page, which You can access after You log-in Your User Account. (5) We do not guarantee the availability of Your User Account at all times. We disclaim all, and will not assume any, liability if for any reason Your User Account becomes unavailable for reasons beyond our reasonable control, including from a denial-of-service attack, virus or other technologically harmful material that may infect your device due to your use of the Internet or otherwise. (6) If applicable, Users may use accounts of other third-party services operated by other companies ("External Services") to log in to services available with their ScanSnap account ("Social Login"). By using Social Login services, the User hereby agrees and consents to each of the following: i) The External Service operators will disclose or provide to us, or share with us the User's registration information held by the External Service operators, which is necessary to enable Social Login. ii)If any of the following events occur on the External Service for which the User registered for Social Login, the User may be temporarily or permanently unable to log in to the Service: -When the User’s External Service account terminates or the User deactivates or withdraws from the External Service. -When there is a failure of the External Service. -When the operation of the External Service is suspended or terminated. -When the specification, features, and/or policy of the External Service have been changed. -In the event that the External Service is unavailable for use. (7)PFU SHALL NOT BE LIABLE FOR ANY DAMAGE CAUSED BY THE REGISTRATION, USE, OR MANAGEMENT OF THE USER'S ID AND PASSWORD FOR THE EXTERNAL SERVICE, OR BY THE USER'S USE OF THE EXTERNAL SERVICE, OR ANY TECHNICAL ISSUES WITH THE OPERATOR OR MEMBERS OF THE EXTERNAL SERVICE, OR ANY OTHER MATTERS RELATED TO THE EXTERNAL SERVICE. USER SHALL USE THE SOCIAL LOGIN FEATURE, INCLUDING THE USER OF ANY EXTERNAL SERVICES, AT THE USER’S SOLE RISK AND RESPONSIBILITY. 3. Your Responsibilities (1) You agree that You will register and use Your User Account for lawful purposes only. You agree to protect the security of Your User Account. You will not disclose, sell, transfer or assign Your Account Registration Information or permit use of Your Account Registration Information by any third party. (2) You assume full responsibility for all use of Your Account Registration Information. You agree that We are authorized to access Your User Account using Your Account Registration Information in accordance with Section 8 below at any time at Our sole discretion.We assume no liability for any injury or loss suffered by You or any third party resulting from the misuse or mismanagement of Your User Account by You or any third party. (3) You agree that You will update Your Account Registration Information promptly whenever necessary in order to ensure that it is always current, complete and accurate. If You provide untrue, incomplete, false, misleading or inaccurate information, You acknowledge that We have the right to terminate Your User Account. (4) Please immediately notify Us at http://www.fujitsu.com/au/support/scanners/ if You believe that any Account Registration Information You provided to Us is no longer secure. (5) You are responsible for obtaining any hardware, software applications, Internet service and other items that You need in order to access and use Your User Account. If You access and use You User Account on Your smartphone, tablet or any other mobile device, You are solely responsible for any and all data fees and other expenses. 4. How to Delete Your User Account You may delete Your User Account by following the procedure provided at "ScanSnap Account Registration Information" page. Deleting an SS account will delete all data stored by the user using the SS account. USER SHALL BE RESPONSIBLE FOR BACKING UP ANY AND ALL USER DATA, FILES, SETTINGS, CONFIGURATIONS, ETC. PRIOR TO THE USER’S DELETION OF THE SS ACCOUNT. TO THE EXTENT PERMITTED BY LAW, PFU WILL NOT BE LIABLE FOR ANY, LOSS OF DATA, INTERRUPTION OF BUSINESS OR ANY INCIDENTAL, SPECIAL, INDIRECT, EXEMPLARY, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND ARISING OUT OF OR RELATING TO USER’S DELETION OF THE SS ACCOUNT, HOWEVER INCURRED, EVEN IF PFU IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES IN ADVANCE BY THE USER. 5. Transfer of Scanner Product If You sell, loan or otherwise transfer Your Scanner Product to a third party, the third party transferee may register a User Account and link it with the Scanner Product only after You de-link the Scanner Product from Your User Account. Please visit "ScanSnap Account Registration Information" of Your User Account for information on how to de-link a Scanner Product to be transferred to a third party. We reserve the right to de-link a transferred Scanner Product from Your User Account (by deleting information relating to the transferred Scanner Product from Your User Account) if You do not do so promptly. 6. If You lease a Scanner Product, You must de-link the leased Scanner Product from Your User Account when You return the leased Scanner Product to Your supplier. We reserve the right to de-link a transferred Scanner Product from Your User Account (by deleting information relating to the transferred Scanner Product from Your User Account) if You do not do so promptly. 7. Suspension or Termination of Account We reserve the right to temporarily modify, suspend or terminate Your User Account at any time in Our sole discretion, with or without notice, and without incurring liability of any kind if (i) You violate this Policy, (ii) We are unable to contact You using Your Account Registration Information, (iii) You violate the terms of any other agreement by and between Us and You or (iv) We reasonably deem modification, termination or suspension necessary to protect Our rights, third party rights or the rights of other Users. If We indefinitely suspend or terminate Your User Account due to Your breach of your usage rights, We will use commercially reasonable efforts to notify You using Your Account Registration Information. We will release the suspension when We have reasonably confirmed that the reason for the suspension has been resolved, and thereafter We will notify You that You may re-commence the use Your User Account. 8. Account Registration Information (1) We use your account registration information within the scope of ScanSnap privacy policy. (i) For marketing purposes, including marketing emails: During the account registration process, You are asked to provide Your "opt-in" consent to receive our marketing emails, such as information new products or services, events, offers, promotions and other news. Unless You consent to receive marketing emails, We will not communicate with You by email other than to provide technical support services, respond to Your requests or communicate information about system maintenance, security or legal issues. If You provide consent and decide at a later time that You do not wish to receive our marketing emails, You may unsubscribe on "ScanSnap Account Registration Information" webpage accessible to You after You log in to Your ScanSnap Account or by following the unsubscribe instructions in Our marketing email. (2) We will deliver required notices to You using Your Account Registration Information. Notices delivered by email shall be deemed given twelve (12) hours after We send the email unless We receive an undeliverable notice. 9. Revisions to This Policy The Effective Date of this Policy is set forth at the "ScanSnap Account Registration Information" page. We may from time to time revise or supplement this Policy. The revised Policy shall be effective when We post it on this webpage. If We make material changes to this Policy, We will notify You in advance by posting a notice on the "ScanSnap Account Registration Information" page and by sending an email to the email address associated with Your Account Registration Information. Your continued use of Your Scanner Product after the Effective Date of this Policy constitutes Your acceptance of this Policy, as amended from time to time. 10. Governing Law; Severability This Policy will be governed by the laws of New South Wales, Australia without regard to conflict of laws principles. If a court holds that such laws do not govern this Policy, the laws of the state or country where You reside govern all claims and disputes under this agreement. As a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these terms and conditions affects your rights as a consumer to rely on such mandatory provisions of local law. If any provision of this Policy is held to be invalid, illegal or unenforceable for any reason by any tribunal of competent jurisdiction, the other provisions shall continue in full force and effect. 11. DISCLAIMER (1) THE USER AGREES AND ACKNOWLEDGES THAT THE SCANSNAP CLOUD AND SCANSNAP ACCOUNT REGISTRATION SERVICE IS A FREE SERVICE, AND IS PROVIDED WITH THE CONTENT AND QUALITY OF SERVICE THAT PFU IS ABLE TO PROVIDE AT THE TIME OF PROVISION OF THE SERVICE. PFU DOES NOT REPRESENT OR WARRANT THAT THE SERVICE WILL MEET THE REQUIREMENTS OF THE USER, THAT THE SERVICE WILL BE ACCURATE OR USEFUL, THAT THE SERVICE WILL CONTINUE TO OPERATE WITHOUT INTERRUPTION OR SUSPENSION, THAT THE SERVICE WILL BE ERROR-FREE, FREE FROM DEFECTS, VIRUSES, AND/OR BUGS, OR THAT THE USER'S USE OF THE SERVICE WILL NOT INFRINGE UPON THE RIGHTS OF ANY THIRD PARTY. PFU DOES NOT GUARANTEE THE RESULTS OF THE USE OF THE SERVICE. (2) PFU SHALL NOT BE LIABLE FOR ANY INTERRUPTION, SUSPENSION, UNAVAILABILITY, OR MODIFICATION OF THE SERVICE, DELETION OR LOSS OF INFORMATION OR IMAGE DATA TRANSMITTED BY THE USER THROUGH USE OF THE SERVICE, OR ANY OTHER DAMAGES INCURRED BY THE USER IN CONNECTION WITH THE SERVICE, EXCEPT AS MAY BE REQUIRED BY APPLICABLE LAW. THE COMPANY SHALL NOT BE LIABLE FOR ANY COMPENSATION FOR DAMAGES INCURRED BY THE USER IN CONNECTION WITH THE SERVICE, EXCEPT AS MAY BE REQUIRED BY APPLICABLE LAW. (3) EVEN IF THE USER IS A CONSUMER UNDER THE CONSUMER CONTRACT ACT OR OTHER APPLICABLE CONSUMER PROTECTION LAWS, AND PFU IS LIABLE FOR DAMAGES TO THE USER, THE AMOUNT OF DAMAGES OWED BY PFU TO THE USER, TO THE EXTENT PERMITTED BY APPLICABLE LAW, SHALL NOT EXCEED THE PURCHASE PRICE OF THE SCANNER PRODUCT PURCHASED BY USER. (5) PFU SHALL NOT BE LIABLE FOR ANY TRANSACTION OR DISPUTE BETWEEN A USER AND ANOTHER USER OR A THIRD PARTY IN CONNECTION WITH THE SERVICE. 12. Handling of Information by PFU (1) PFU shall handle the User's personal information, including User information, in accordance with the "ScanSnap Personal Information Protection Policy" (https://www.pfu.ricoh.com/imaging/agreement/privacy/privacyFALen.html). and by using the services, the User agrees and consents to such handling. (2) PFU may, at its sole discretion, utilize the information and data, etc. provided by the User to PFU through the means of communication stipulated in Paragraph 12, Item (2), as statistical information in a form that does not identify individuals for the purpose of service improvement. The anonymized data will be used, processed, and stored in accordance with applicable data protection laws and the ScanSnap privacy policy. (3) In accordance with the Telecommunications Business Law or other applicable law, PFU shall not violate the confidentiality of communications of Users and third parties in providing the Service, and shall not disclose, view, or disclose to any third party any image data, except as permitted as a legitimate business act for the provision of the Service. (4) Notwithstanding this paragraph, in any of the following cases, PFU may disclose to a third party to the extent necessary information, data (including image data) provided by the User, history of use of the Service by the User, etc. (i) When required by law (ii) When PFU deems it necessary for the protection of life, body, or property, and it is difficult to obtain the consent of the User. 13. Communication and Notification (1) Notices from PFU to the User regarding the Service "including notices regarding revisions to the Terms" shall be sent by e-mail to the e-mail address included in the User's information or posted on the Service Site. (2) Any inquiries or communications from the User to PFU regarding the Service shall be made by e-mail or telephone to the "Contact Us".
